AREAS OF PRACTICE
Edward's experience includes providing advice on the full range of intellectual property including the ownership, maintenance, protection and exploitation of intellectual property, clearance work and advice and dispute resolution.
Edward has particular experience in dispute resolution, both in resolving disputes pre-action and in formal litigation. Edward has been involved in bringing and defending a wide range of claims in the High Court, Patents County Court, Court of Appeal, before the UK Trade Marks Registry and in relation to claims under Nominet's DRP Policy and ICANN's Uniform Domain Name Dispute Resolution Policy. Edward also has particular experience in advising public sector bodies, particularly those in the health sector, on all aspects of the ownership, maintenance, protection and exploitation of intellectual property.
Edward advises a wide range of clients including brand owners, financial institutions, public sector bodies, e-commerce technology companies and organisations in the manufacturing and construction industries.
RELEVANT EXPERIENCE
- Advising the DHSSPS in Northern Ireland regarding intellectual property issues connected with the procurement of software maintenance and development services agreements in respect of a new in-house payroll system.
- Advising NHS Connecting for Health ("NHS CfH") regarding the ownership and exploitation of intellectual property arising from an agreement with a leading university regarding a training and analysis service for the development of information in primary care.
- Advising NHS CfH with respect to its negotiations with the Copyright Licensing Agency for a central copyright licence for the NHS in England, including devising strategies with NHS CfH to ensure that the NHS in England receives value for money from the central licence.
- Advising the UK Terminology Centre (part of NHS CfH) regarding the licensing of cross maps developed by the UK Terminology Centre to IHTSDO.
- Providing policy advice to NHS CfH regarding IP/IT liability issues of NHS CfH with respect to the acts of its employees.
- Developing standard form documentation for NHS CfH with regard to the exploitation of the intellectual property in clinical knowledge applications developed for the Department of Health.
- Advising NHS CfH regarding intellectual property issues connected with the development of test bed software as part of the NHS Programme for IT.
- Advising NHS CfH regarding a dispute in respect of a trade mark application filed by a commercial supplier to NHS CfH.
